Terms of Use

These terms apply when you use this website, create a BYBU account, or book wellness classes or class packs with BYBU Aesthetics & Wellness. By creating an account or completing a booking, you confirm you have read, understood, and accept these terms. If you do not accept them, please do not use the site.

2. Your account
- You must be 18 or over to create an account or buy a class pack.
- Please give us accurate information and keep it up to date.
- Your account is for you. Keep your password secret and let us know straight away if you think someone else has used it.
- You can close your account at any time — see our Privacy Policy for how we handle data on closure.
- We may suspend or close an account if it is used in breach of these terms or for unlawful, abusive, or fraudulent activity.
3. Wellness bookings and class packs
- Drop-in class spaces and class packs are booked and paid for through this site. Prices, credits, and pack details are shown at checkout.
- Class packs are valid for 2 months from the date of purchase. Credits are non-transferable. Credits not used within the validity period expire and are not refundable, except where the law requires otherwise.
- Capacity is limited. Booking is on a first-come, first-served basis.
- Cancellation by you: you can cancel a booking yourself up to 24 hours before the class start time, using the link in your booking email or your account page. Cancellations with at least 24 hours' notice release your credit (if you booked with one) or trigger an automatic refund to your original payment method (if you paid by card). Card refunds typically appear on your statement within 5–10 working days.
- Inside the 24-hour window: please call or message the studio. Late cancellations and no-shows may not be refunded or credited, at our discretion.
- Cancellation by us: if we cancel a class, we will email you and either restore your credit or refund your payment, at your choice.
4. Your statutory right to cancel a distance contract
Under consumer law in Gibraltar (and equivalent rules in the UK and EEA), you normally have 14 days from the date of purchase to cancel a contract concluded online and receive a full refund.
- Class packs (services to be supplied later): you may cancel within 14 days of purchase for a full refund provided no credit from the pack has been used. Once you book and attend a class using a credit from the pack, you have accepted that the service has begun, and the unused-credit refund right does not apply to that portion of the pack.
- Drop-in class for a specific date: if the class falls within the 14-day window, by completing checkout you expressly request that we begin providing the service before the 14-day window ends. You acknowledge that, in line with Gibraltar consumer law, this means you lose your right to cancel once the class has taken place.
- To exercise the right to cancel, email info@bybuaesthetics.com with your booking reference, or use the cancellation link in your booking email. Refunds for eligible cancellations are made to the original payment method within 14 days.
5. Aesthetic treatments
Aesthetic treatments (facials, injectables, laser, body, and similar) are booked through Fresha and are governed by Fresha's booking terms and our separate consultation and consent paperwork at the clinic. These website terms do not apply to the booking process on Fresha; they apply again to your in-clinic visit and to any personal data we record about it. Refund and cancellation rules for aesthetic treatments are set out in the consultation paperwork signed before treatment.
6. Payments
Payments for wellness classes and class packs are processed by Stripe. Card details are handled entirely by Stripe and never reach our servers. Apple Pay, Google Pay, Link, and standard card payments are accepted at checkout where supported by your device.
7. Your health and participation
Yoga, Pilates, meditation, and any other wellness sessions are not a substitute for medical advice. If you are pregnant, recovering from injury, or living with a health condition that may affect your participation, please tell the instructor before class. You participate at your own risk, within reasonable limits and applicable law. We may decline a booking, modify a session, or end a session if continuing would not be safe for you, the instructor, or other attendees.
8. Acceptable use
- Do not try to interfere with, break, scrape at scale, probe, or abuse the site.
- Do not attempt to gain access to accounts, dashboards, or data you are not entitled to.
- Do not use the site to send unlawful, threatening, harassing, defamatory, infringing, or otherwise objectionable content.
- Do not use the site to impersonate another person.
- We reserve the right to investigate suspected misuse, suspend or close offending accounts, and where appropriate involve the Royal Gibraltar Police or other authorities.
9. User-submitted content
If you submit content to the site — for example, a review, photo, testimonial, or message — you grant us a non-exclusive, royalty-free, worldwide licence to use, store, display, and (with attribution where reasonable) share that content for the purpose of operating and promoting the studio. You confirm you own or have permission to share the content. We may remove any content at our discretion if it breaches these terms, is unlawful, or is misleading.
10. Intellectual property
All content on the site — including text, images, video, the BYBU name and logo, photography of the clinic and team, and the underlying code — is owned by us or licensed to us and is protected by intellectual property laws. You may view and share links to the site for personal, non-commercial use. You may not copy, republish, redistribute, resell, or create derivative works without our prior written permission.
11. Our liability
We take reasonable care to keep the site available, accurate, and secure, but we do not promise that it will always be uninterrupted, error-free, or free from delay or compatibility issues with every device. To the maximum extent allowed by law:
- We are not liable for indirect, consequential, special, or punitive losses arising from your use of the site, including loss of profits, business, goodwill, data, or opportunity.
- Our total liability for any matter relating to your use of the site or a wellness booking is limited to the amount you paid us in the 12 months before the event giving rise to the claim, or £100, whichever is higher.
Nothing in these terms limits or excludes our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be limited or excluded under Gibraltar law.
12. Indemnity
You agree to indemnify and hold us harmless against any reasonable losses, costs, and liabilities (including reasonable legal fees) we incur because of your breach of these terms or your unlawful use of the site, except to the extent caused by our own negligence or breach.
13. Force majeure
We are not liable for any failure or delay in performing our obligations caused by events outside our reasonable control — including industrial action, network or hosting outages affecting the site, severe weather, public health restrictions, government action, or interruption of utilities at the clinic. Where this happens we will let affected clients know and reschedule, restore credits, or refund as appropriate.
14. Privacy and cookies
Your privacy is covered by our Privacy Policy. Cookies are explained in our Cookie Policy. The third-party suppliers we use to run the site are listed at /legal/processors.
15. Children
This site and our online booking are aimed at adults. Children may attend appropriate classes with a parent or guardian, who handles the booking, payment, and any health disclosure on the child's behalf.
16. Complaints
If something is wrong, please tell us first — email info@bybuaesthetics.com or call +350 5406 8245 and we will do everything reasonable to put it right. If we cannot resolve a complaint to your satisfaction, you can refer it to the relevant Gibraltar authority:
- Consumer matters: the Office of Fair Trading (Gibraltar) — www.oft.gov.gi.
- Data protection matters: the Gibraltar Regulatory Authority (GRA) — www.gra.gi/data-protection.
17. Changes to these terms
We may update these terms from time to time. The "Last updated" date at the top shows when we last did. Material changes that affect your existing bookings or rights will be notified by email to signed-in clients. Continuing to use the site after a change means you accept the updated terms.
18. Severability and waiver
If any part of these terms is found to be unenforceable, the rest will remain in full force. If we do not enforce a right under these terms, that is not a waiver of that right — we may enforce it later.
19. Governing law and jurisdiction
These terms are governed by the laws of Gibraltar. Any dispute will be handled by the courts of Gibraltar, save that nothing here removes any mandatory consumer-law right you have in your country of residence.
